Copyright Infringement Notice and Takedown Policy

1. Introduction and Scope

Baiiiz.com (operated by Webzieh Creations Limited) respects the intellectual property rights of others and requires its users to do the same. This policy establishes a procedure for copyright owners to notify us of alleged copyright infringement on the websites created by our Users via the Baiiiz.com platform (the “Service”).

2. Designated Agent

For the purpose of receiving notices of copyright infringement, our designated agent is:

3. Reporting Infringement (Takedown Notice)

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via a website created on the Baiiiz.com platform, you must send a written communication to our Designated Agent listed above with the following information (the “Takedown Notice”):

1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.

2. Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the infringing product page on the User’s store).

4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.

5. Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury (or similar legal penalty), that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Baiiiz.com Response to Takedown Notices

Upon receiving a valid Takedown Notice, we will:

1. Remove or disable access to the allegedly infringing material hosted on the User’s website.

2. Take reasonable steps to promptly notify the User (the person who provided the material) that the material has been removed or disabled.

3. Implement a policy to terminate the accounts of Users who are determined to be repeat infringers.

5. Counter-Notice Procedure

If a User believes that the material removed or disabled is not infringing, or that the User has the right to post and use such material, the User may send a counter-notice to our Designated Agent. The counter-notice must include the following:

1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

2. A statement, under penalty of perjury, that the User has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

3. The User’s name, address, telephone number, and email address.

4. A statement that the User consents to jurisdiction in the appropriate court in the United Kingdom and that the User will accept service of process from the person who provided the original Takedown Notice.

We will provide the original complaining party with a copy of the counter-notice and will inform the party that we may replace the removed material or cease disabling access to it in 10 to 14 business days unless the complaining party notifies us that they have filed an action seeking a court order to restrain the User from engaging in infringing activity related to the material.
